These Terms of Service ("Terms") govern your access to and use of MergeControl, a Git hosting and collaboration service operated by Nodion GmbH, Königstraße 27, 70173 Stuttgart, Germany ("we", "us", "our").
By accessing or using MergeControl, you agree to be bound by these Terms.
MergeControl provides Git repository hosting and related collaboration features, including but not limited to repository management, code review, and CI/CD functionality ("Service").
The Service is currently offered free of charge, including free private repositories, subject to fair use.
We may modify, suspend, or discontinue parts of the Service at any time.
You must be legally capable of entering into a binding agreement to use the Service.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You retain full ownership of all code, repositories, and other content you upload to MergeControl ("Your Content").
By using the Service, you grant us a limited, non-exclusive, revocable license to host, store, process, and transmit your content solely for the purpose of operating and improving the Service.
We do not sell, license, or monetize your Content.
You agree not to use the Service to:

The Service is provided on a best-effort basis.
While we aim for high availability, we do not guarantee uninterrupted or error-free operation.

We reserve the right to introduce usage limits, paid plans, or additional features in the future. Any such changes will be communicated in advance.
Abuse of free resources may result in restrictions or suspension.
You may stop using the Service at any time.

MergeControl, its design, and branding, are the intellectual property of Nodion. These Terms do not grant you any rights to our trademarks or proprietary materials.
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Nodion shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service (if any) in the preceding 12 months.
We may update these Terms from time to time. Changes will be posted on this page and become effective upon publication. Continued use of the Service constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules. The place of jurisdiction is Stuttgart, Germany, unless mandatory consumer protection laws provide otherwise.
